    Event Terms & Conditions

    I will always do my best to fulfil and, hopefully, even exceed your photography needs, but it’s often best for everyone to have some terms in writing.

    Please read the following terms carefully and tick "I agree" for each one. If you don't agree on something, please give me a call!

    1. Retainer and Payments. The Client shall make a non-refundable retainer in the amount of €300 for the Photographer to reserve the time and date agreed upon by both parties. The Client agrees that this retainer is earned by the Photographer when paid in consideration of the inability of the Photographer to schedule other clients during this time. Remaining balance of the amount agreed is due no later than 7 days prior to the event.

    2. Cancellation. If for any reason the Client cancels this Contract prior to or on the event date, the Photographer shall keep the retainer and any monies paid on the date of cancellation. All cancellations must be made in writing and signed by all contracted parties. If the Client fails to supply written cancellation or cancels within 7 days of the contracted date, the Client shall be required to pay the full balance of the Contract.

    3. Rescheduling. If, for any reason, the Client reschedules the event at least 8 weeks prior to the event date, and such rescheduling is confirmed in writing to the Photographer, the retainer may, at the Photographer’s sole discretion, be applied to the new date.

    4. Failure to Perform. If the Photographer is unable to perform this Contract due to illness, emergency, fire, casualty, strike, act of God or causes beyond the control of the Photographer, the Photographer shall make every attempt to provide a Substitute Photographer per the provisions in this Contract. If a substitute photographer cannot be found then liability is limited to a refund of any payments received. The Photographer has working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond the Photographer's control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied. The Photographer has full public liability and professional indemnity Insurance.

    5. Artistic Rights. The Photographer retains the right of discretion in selecting the photographic materials released to the Client. The Photographer also retains the right to make adjustments to the photographs in post-processing as the Photographer deems within their creative control. Additional processing may be requested for €50 per file.

    6. Copyright and Reproductions. The Photographer shall retain copyright ownership of all works created in the course of this event, including but not limited to all images in their original and processed formats. It is understood that any duplication or alteration of original images is strictly prohibited {Copyright and Related Rights Act, 2000} without the written permission of the Photographer. Alterations include, but are not limited to, application of filters, cropping, or modifications of any kind.

    7. Client Usage. The Client shall only use the photographic prints, including digital files, in accordance with the permissions within this Contract. The Client’s prints are for personal use only and shall not be submitted to contests or reproduced for commercial use. The Client shall not make, or provide authorization to a third-party to make, reproductions of works resulting from this Contract without express permission of the Photographer.

    8. Social Media. The Client shall identify the Photographer with the mention “Copyright Johanna King Photography” in the caption of all photographs uploaded to social media websites and profiles.

    9. Promotion. The Photographer may use reproductions of the images for promotional purposes, including advertising, marketing materials, website and internet promotion or for viewing within or outside the studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client. If the Client does not want any of the images used for self-promotion, the Client shall let the Photographer know ahead of the event and the Photographer will respect those wishes.

    10. Photographic Materials. All photographic material shall be the exclusive property of the Photographer. No products, including digital files, will be released until the agreed upon amount is paid in full per the payment schedule outlined in this Contract.

    11. Number of Images. The Photographer is unable to guarantee the number of images which will be produced from the event. However, on average most clients receive 25 images per hour of coverage. Every possible attempt will be made to shoot every important image as well as images on the Client's wish list. However due to the nature of event photography and unforeseen circumstances the Photographer cannot guarantee that all shots will be included. Original photographs are not included, only edits. The Photographer retains the right to edit the photographs and omit any image. It is understood that the Photographer will not deliver every exposure taken.

    12. Digital Images Deliverables. The Client will receive digital images through digital download.
    The Client is responsible for making a backup of all photos. The Photographer will make every attempt to keep archival copies of photos, but does not guarantee that they will be retained indefinitely.

    13. Completion Schedule. Completion of processing and edits of an event takes approximately 2-4 weeks. The Photographer shall not be held responsible for delivery delays.

    14. Indemnification. The Photographer shall be held harmless for any and all injury to the Client and the Client’s property during the course of the photographic event and the immediately surrounding events.

    15. Miscellany. This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties. Irish Law shall govern this Contract.
